2019 Rental Contract
THE RENTAL AGREEMENT is made and entered into on the above date by and between the Camp Breckinridge Museum & Arts Center, 1116 North Village Road and_____________________________,
WITNESSETH: In consideration of the premises contained herein and the mutual and dependent covenants, conditions, and agreements more particularly hereinafter set forth, and the rent hereinafter to be paid, LESSER leases to LESSEE and LESSEE hereby leases from the LESSOR for the above date, commencing at ___________ _____m. and terminating at __________ ___m., the following rental property.

TO HAVE AND HOLD the rental premised with all of the rights and privileges thereto appertaining unto the Lessee for the above period upon the following covenants, conditions, and agreements. A deposit of $ 150.00 is to be made the day the contract is signed.
Lessee agrees to pay Lessor, without demand, as rent for the premises, the sum of _________ plus
$ 12.00 per hour, payable in a separate check to the building attendant for the number of hours he/she attend the building other than regular business hours. The building cannot be rented without an attendant.
Payment must be made at the Museum & Arts Center. That amount is deposited and will be subtracted from the amount of rent you will owe. This deposit amount is nonrefundable if lesser does not cancel within 30 days the contract was signed. That is the today’s date on the contract.
Within 48 hours after the termination of the rental property by the Lessee, the Lessor shall inspect the rental premises. If after the inspection the Lessor deems that damage was sustained, estimates will be taken for repair. The Lessee will be responsible for paying for the cost of repair work to the building.
B) USE OF PREMISES
The rental hall shall be used by Lessee, and all invited guests of Lessee exclusively as a reception hall, and shall not be used at any time during the terms of this contract for carrying on any business, profession, or trade of any kind, for any unlawful purposes, or for any purpose other than a rental hall.
Lessee shall keep the number of invited guests in the rental premises below the maximum legal capacity of 300 persons.
Lessee shall not keep or permit anything to remain on the rental premises or use the rental premises in a manner that causes harm or causes the insurance rate to be increased.
Outdoor cooking and barbecues are considered a fire hazard and are therefore not permitted without prior consent from the lesser. No games of any kind may be played without consent from the lesser. Lessee shall not do or permit anything to be done in or about the rental premises which may become a nuisance or which may interfere with or disturb the nights, comfort, or convenience of residents of the surrounding neighborhood of community. Lessee shall, at all times, keep and maintain the rental premises in a clean and sanitary condition. Lessee shall dispose of all refuse, rubbish, garbage, and other waste from the leased premises in the receptacles provided for such purpose.
Lessee shall use the kitchen facilities (if ballroom is rented) appropriately. Frying of foods is not allowed. Using hot plates or burners is not allowed. Lessee shall leave the kitchen and other areas in the same condition as was present upon arrival. Do not leave food particles in the sink and do not pour sauce down the drain.
Lessee shall post all signs and notices supplied by the Lessor in the designated locations, for the entire duration of the rental period.
C) COMPLIANCE WITH LAWS AND REGULATIONS
Lessee shall comply with all existing or future laws and regulations affecting the rental premises which may have been or which may be adopted, passed, or issued by the City of Morganfield Union County, or the Commonwealth of Kentucky, or by any other governmental agency, particularly with respect to alcoholic beverages.
D) REPAIRS AND MAINTENANCE
Lessee shall keep and maintain the rental premises in good condition and repair at all times during the term of this rental contract. Lessee shall promptly notify Lessor, in writing, of any damage or defect in the water pipes, electric wiring, fixtures, or heating units. Lessor shall, if such damage or defect is not the result of any act of neglect of Lessee or any other person on the rental premises, be responsible for repairing the same.
Lessee shall be responsible for, whether resulting from negligence or otherwise, all injury, damage, or breakage done by Lessee, invitees, or guests. If Lessee fails to make arrangements for the repair within 14 days after written notice by Lessor, the Lessor shall contract the work to be done. The Lessor shall submit an itemized bill for the actual and responsible cost of the repair to the Lessee, for immediate payment.
E) ALTERATIONS AND IMPROVEMENTS
Lessee shall make no alterations to, or make improvements on, the rental premises without prior consent on the Lessor. In any event, no holes shall be drilled and no tape applied to the walls, woodwork, or floors of the rental premises. Lessee shall not remove any objects, such as pictures, etc. from the walls of the premises.
The Lessee shall not decorate the building or place any decorations in and around the interior or exterior of the building without consent of the Facility Manager.
The Lessee shall be responsible for any damages or defacing of the painted murals on the walls of the Museum & Arts Center, whether or not the damage is a result of the Lessee, invitees or guests. The murals shall not be covered in any way.
Beer, wine or distilled spirits shall not be sold on the premises. If the Lessee shall choose to serve alcohol to their guests, they shall do so in accordance with Kentucky State Law. Under no circumstances shall anyone under the age of 21 consume alcohol, they shall be solely responsible and indemnity the Lesser for any or all claims and causes of actions as a result of serving an underage person, including all civil and criminal responsibility.
Should the Lessee serve beer, wine or distilled spirits to their invited guests who are under or over the age of 21, the Lessee shall indemnify and hold harmless the Lessor from any and all claims, injuries, damages or any other causes of actions, including wrongful death actions that may occur as a result of the consumption of any alcoholic beverages by the lessee, their guests, or any other person who consumes or is served alcohol, directly or indirectly, in or around the premises. Beer must be served in cans or bottles only.
ASSIGNMENTS AND SUBLETTING
Lessee shall have no right to assign this lease, nor to sublet or grant any concession or license to use the rental premises.
J) CONDITION OF THE PREMISES; RESPONSIBILITY FOR INJURY
Lessee has / has not (CIRCLE ONE) inspected the rental premises, acknowledges that such is in good condition, and accepts the same in its present condition.
Lessee shall indemnity and hold harmless from and against all claims for damages and expenses of every kind and character to parties who may claim, sue, or demand damages for injuries sustained upon leased premises resulting from acts of omissions of Lessee, the members of its family, and Lessee’s or Lessee’s invited guests or invitees. Lessee will defend any such claim or suit for damages for injuries at its own expense.
LESSOR STRONGLY RECOMMENDS THAT LESSEE SECURE ADEQUATE INSURANCE TO PROTECT LESSEE AGAINST SUCH OCCURRENCES.
K) PERSONAL PROPERTY
Lessor shall not be liable to Lessee, the members of Lessee’s family, and Lessee’s guests or invitees for any personal property damage caused by act or omissions of other persons. Lessor shall not be liable for losses or damages to property from fire, theft, and other casualty not resulting from the acts or omissions of Lessor.
At the expiration of the period of this contract, Lessee shall immediately remove all of Lessee’s personal property from the rental premises. If Lessee does not immediately remove property, Lessor is expressly authorized to remove and store Lessee’s personal property, at Lessee’s sole cost and expense. If Lessee does not claim personal property within 30 days after removal, Lessor may sell or dispose of the same and apply the proceeds, if any, to any unpaid rental, damages, storage fees, cost of sale, and reasonable attorney’s fees.
L) DAMAGE TO OR DESTRUCTION OF PREMISES
Lessee agrees to pay as rent herein provided unless the lease premises shall be destroyed or rendered unusable, through no fault of Lessee, in which event Lessee shall immediately notify Lessor in writing of its intentions to terminate this rental contract. Lessee shall be liable for the stated rent if this is not terminated as herein provided.
If Lessee shall fail to pay the remainder of rent due at least 30 days before the rental date, Lessor may terminate this rental contract and retain the security deposit.
Lessee shall not permit domestic or other animals on or about the rental property.
Lesser and its agents shall have the right, at any time during the period of this rental contract, to enter the leased premises for the purpose of inspecting the same. There will be an overseer of the building on the premises at all times during the rental hours of the contract.
It is understood and agreed that the rental premises are received in good order and condition, and the Lessee hereby acknowledges that it has been notified of existing damage to the leased premises, if any, which items of damage would be the basis for a charge for repairs of maintenance as stated in Section D.
Upon the expiration of this rental contract, Lessor shall inspect the leased premises within 48 hours and complete a comprehensive listing of any damages to the leased premises, which is the basis for any charge to the Lessee and the estimated dollar cost of repairing such damage. Lessor and Lessee agree to sign the listing, and such signatures shall be conclusive evidence of the accuracy to such listing.

P) TERMINATION BY LESSOR
Not withstanding any other provision contained in the rental contract, this rental contract may be terminated by Lessor up to the hour of the scheduled if Lessor is informed by a reliable source that Lessee or Lessee’s family, invitees or guests plans to willfully or intentionally commit a violent act or behave in a manner which constitutes or threatens danger to the health, safety, or welfare of the life or property of other persons or the rental premises. Such notices of termination shall become effective immediately.
If Lessee has made a material misrepresentation in the negotiations conducted in connection with this rental contract, Lessor may, in its sole discretion, treat the same as a breach of this lease and may exercise any of the remedies available to Lessor.
In the event Lessor employs an attorney because of a willful default by Lessee under the terms and conditions of this contract, Lessee shall be liable for reasonable attorney fees and other costs of expenses incurred by Lessor in connection therewith.
Lessee shall abide by all rules and regulations now or hereafter adopted by Lessor for the administration of the rental premises. A copy of the existing rules and regulations have been furnished to Lessee, receipt of which is here by acknowledged, and the same are incorporated herein by reference and made a part hereof. Lessee shall be given notice of any change in such rules and regulations prior to the scheduled date of rental.
SURRENDER OF POSSESSION
The rental property must be in good condition and as clean as when rented.
COVENANT OF PEACEFUL POSSESSION
Lessor agrees, under the terms of this contract, to keep Lessee in peaceable and uninterrupted possession of the rental premises as long as Lessee complies with and performs all of the terms, covenants, and conditions of this lease.
Any notice required or permitted to be given by either party under the terms of this lease, shall be given in writing and shall be delivered in person or sent by certified mail, postage prepaid. Notices to Lessor, unless Lessor advises Lessee in writing, by delivered or addressed to Lessee, at the address stated below Lessee’s signature on this rental contract.
This rental contract contains the entire agreements between the Lessor and Lessee. Neither this lease nor any provision hereof may be altered, amended, or modified orally, but only an instrument in writing signed by or on behalf of each party hereto. The obligations assumed are joint and several are declared to be binding upon heirs, legal representatives, successors, and assigns of the parties hereto.
All covenants and agreements of Lessee a specifically agreed conditions and are to be enforceable as such if Lessor so elects. Time shall be of the essence with respect to the performance of the obligations of Lessee arising under this rental contract.
This rental contract shall be governed by and constructed in accordance with the laws of the Commonwealth of Kentucky. If any provision of this rental contract or the application thereof to any person or circumstance shall be declared to be invalid or unenforceable to any extent, the remainder of this rental contract and the application of such provision to other persons or circumstances shall not be affected thereby and shall be enforced to the fullest extent permitted by law.
